Parimutuel betting is legal in some form across most of the US. While laws and regulations vary by state, they are generally strict; authorities typically classify this wagering as skill-based rather than chance-based.

Bettors can place wagers in person at brick-and-mortar establishments or online via advance deposit wagering (ADW). Here is a deeper dive into how pari-mutuel gaming typically works in states where it is legal.

Where is pari-mutuel betting legal?

The majority of states — more than 40 — allow various forms of parimutuel betting. Horse racing remains the cornerstone of the industry, but the market is evolving rapidly with the introduction of mobile-first platforms.

A major milestone for the industry happened with the official launch of GiddyUp. The app is now live and accessible to residents in 17 states:

  • Alabama, California, Colorado, Connecticut, Delaware, Florida, Kansas, Louisiana, Michigan, North Dakota, Nebraska, New Mexico, New York, Oklahoma, Rhode Island, Wisconsin, and Wyoming

A notable exception to online wagering is Texas, which allows live betting at tracks but explicitly prohibits ADW.

While pari-mutuel activities involve wagering, they are often legally distinguished from “gambling” in a traditional sense. From a legal perspective, pari-mutuel betting is frequently classified as a game of skill based on two main factors:

  1. Public-vs.-House System: In pari-mutuel betting, players wager against one another rather than against “the house.” All wagers are pooled, and the house takes only a fixed administrative fee.
