Nebraska is one step closer to legalizing online sports betting.
State officials say a petition to place a constitutional amendment on the November 2026 ballot cleared both required signature thresholds.
Nebraska already allows sports betting at licensed racetracks, but not on mobile devices statewide.
If voters approve the amendment, the state’s five racinos could each partner with online sportsbook operators under oversight from the Nebraska Racing and Gaming Commission.
Petition clears signature hurdle for statewide vote
The Nebraska Secretary of State’s office said the petition for the Online Sports Wagering Authorization Constitutional Amendment met both required thresholds, according to TheLines. The petition reportedly had at least 138,473 valid signatures, which met the 110% threshold required for ballot qualification.
Tax Relief Nebraska began gathering signatures last fall. Petitions sent out in November 2025 were supported by BetMGM, DraftKings, FanDuel, and Fanatics.
The campaign reached the July 3 deadline to collect signatures, and the Secretary of State must certify the 2026 ballot by Sept. 11.
The office will now hold public hearings on how to proceed before the measure is finalized for the ballot.
Jordan McGrain, spokesperson for Tax Relief Nebraska, told the Nebraska Examiner that he believes “voters will agree that a legal and regulated online sports wagering marketplace will keep the money in Nebraska.” He also said revenue would help “local communities.”
What the amendment would allow
If approved in November, the constitutional amendment would allow each of Nebraska’s five racinos to operate up to two online sportsbooks. Those platforms would be regulated by the Nebraska Racing and Gaming Commission, and operators would have to submit controls to the commission for approval.
The commission would have until June 1, 2027 to implement new rules. The measure also says sports betting winnings would be checked against the state debt collection database.
Nebraska legalized sports betting at licensed racetracks in May 2021, but efforts to add mobile wagering failed in 2024. This ballot path gives voters a direct say on whether the state should expand beyond in-person betting.
WarHorse Casino is already in discussions with possible online sportsbook partners, including FanDuel, BetMGM, and DraftKings.
