Are online casinos legal in New York?

Not yet. State Sen. Joseph Addabbo has been the driving force behind online casino legalization in New York, but he’s thus far not been able to get a bill over the line. An April 2024 bill did not make the state budget, but we’ll see if a bill can work its way into the 2025-26 budget.

The bigger news is that New York has moved to ban sweepstakes casinos in 2025. The prohibition has not made it across the desk of Gov. Kathy Hochul just yet, but the bill blazed through the statehouse. Will New York legalize real-money online casinos in the future?

It’s still unclear if real-money online casinos will be allowed in New York. State Senator Joseph Addabbo introduced Senate Bill S2614 in January 2025 to allow the state to sell lottery tickets and engage in online interactive gaming. With a proposed tax rate of 30.5% on online casino revenues, the bill suggests awarding up to 31 licenses to various independent operators, commercial casinos, and tribal gaming entities.

Despite these efforts, the bill still faces many obstacles. Legislation to legalize online casinos was conspicuously left out of Governor Kathy Hochul’s 2025 executive budget, indicating that the initiative does not currently have executive support. Assemblywoman Carrie Woerner, chair of the Assembly Racing and Wagering Committee, has also voiced doubts about the bill’s chances, indicating that legalization is not likely to happen in 2025.

Labor unions, especially those representing casino employees, have also raised concerns about the possible effects of internet gaming on jobs at physical casinos. To counteract possible job losses, the proposed legislation provides $25 million yearly for workforce development and contains provisions for labor peace agreements.

Additionally, decisions regarding awarding up to three new downstate casino licenses are anticipated by the end of 2025. Until these licenses are completed and the new casinos are open, lawmakers might be reluctant to move forward with legislation about online casinos.

In light of these considerations, considerable obstacles still stand in the way of New York’s continued legislative efforts to legalize online casinos. Depending on changes in political support and the resolution of current issues, stakeholders and observers believe that 2026 may be the earliest practical date for legalization.

Will the sweepstakes casinos come back to New York?

Highly unlikely. The banning bill moved through the state senate with 57-2 support. That’s not the kind of margin that flips easily.

If anything, Sen. Addabbo’s spearheading of the sweeps ban is meant to clear the regulatory path for real-money casinos, like BetMGM and DraftKings.
