Are online casinos legal in Texas?

Real-money online casinos are not legal in Texas. In states such as New Jersey, Pennsylvania, or Michigan, licensed operators can offer real-money online casino gambling over the internet. However, Texas law currently prohibits this practice. Efforts to legalize real-money iGaming in Texas have been introduced in the legislature in recent years, but none have passed.

That doesn’t mean Texans are without options. Anyone 18 or older can legally enjoy online slots, table games, and other casino-style entertainment at social casinos and sweepstakes casinos. These platforms operate under federal sweepstakes law and are available throughout the Lone Star State.

When you play at a sweepstakes casino, you can choose to play with one of two currencies:

  • Premium currency (usually called Sweeps Coins, or SC) can be redeemed for cash prizes once eligibility requirements are met.
  • Non-premium currency (often called Gold Coins, or GC) cannot be redeemed for real-world prizes.

Both currencies are available to players for free. Since players can play for free and use virtual currencies and not real money directly, they are allowed under Texas gambling laws.

What about offshore sites?

Some online casinos based overseas will try to attract Texans. These sites are sometimes known as “offshore” gambling sites because they are generally based in the Caribbean or Central America. Prominent examples include Bovada, BetOnline, MyBookie, Wild Casino, Ignition Casino, America’s Cardroom, and DuckyLuck.

These are unregulated casinos,  So, they do not fall under the jurisdiction of federal authorities or state authorities in Texas. This leads to several potential issues:

  • No government entity in the United States has tested the games independently to ensure fairness and accuracy.
  • If you win, an offshore casino may simply decide not to pay you. You will have no legal recourse, as these sites are not regulated.
  • No entity has verified an unregulated site’s cybersecurity. They often fall short in this regard. And again, if your personal and financial information falls into the wrong hands, you will have no legal recourse.

Thousands of Americans have been scammed when using offshore gambling sites, so it is best to avoid them. Stay safe and play at sweepstakes casinos in Texas instead.

Will Texas legalize real-money online casinos in the future?

Possibly, but it’s still very unlikely. There are no forms of real-money online gambling that are legal in Texas.

Previous attempts to legalize any online gambling have been thwarted by a powerful group of lawmakers, led by Lieutenant Governor Dan Patrick, who opposes gambling. For example, in 2023, the Texas House of Representatives passed a sports betting bill, which would have given voters the chance to authorize online sports wagers. However, it died in the Senate.

Even online lottery couriers, which had been briefly operating in the state in a partnership with the Texas Lottery Commission, have been shut down. In fact, Patrick helped lobby the state to disband the Texas Lottery Commission for allowing the partnership in the first place.

If Texas legalizes sports betting, the chances of introducing regulated online casinos would improve significantly, but proponents of gambling expansion must still overcome several major hurdles. Patrick has repeatedly insisted that there is little to no support for expanding the state’s gambling industry from members of the Senate GOP. Unless that situation changes, we are unlikely to see Texas regulate online casinos any time soon.

What online casino games are available in Texas?

Texans can enjoy a wide range of casino games. The best social and sweeps casinos source their games from the world’s best software studios, including NetEnt, Hacksaw, Rival Gaming, Pragmatic Play, and BGaming.

These are the main categories of games you’ll find in Texas:

Slots

Texas offers a range of slots. If you visit a site like Pulsz or WOW Vegas, you can choose from more than 800 slots. They range from classic 3-reel slots to modern games with all sorts of dazzling features.

The basic premise is always the same: select your bet size, spin the reels, and await the results. If certain matching symbols appear on one or more of the paylines, you will win.

However, the best slots offer lots of different features to make the gameplay more varied and interesting, such as Megaways paylines, progressive jackpots, bonus rounds with multipliers, wild symbols, cascading reels, bonus buy options, and much more.

Video poker

Video poker is a card game that requires you to build the best five-card hand possible. You will play against the house, as opposed to rival players.

Texans can play video poker games such as Jacks or Better and Deuces Wild at a few of the leading social and sweeps casinos. These sites offer video poker games in the Lone Star State:

  • Chumba Casino
  • High 5 Casino

  • Sweeptastic

If Texas legalizes online casinos, you will be able to use a broad variety of secure, convenient payment methods. These are some of the popular payment methods that players can use at sweepstakes and social casinos.

Retail Casinos in Texas

Texas is home to two retail casinos. Both of them are owned and operated by federally-recognized Native American tribes and are situated on tribal lands.

For now, these two casinos are the entirety of the retail casino scene in Texas. So, here’s the details for both of them.

  • Address: 794 Lucky Eagle Drive, Eagle Pass, Texas
  • Phone: 888-255-8259
  • Tribe: Kickapoo Traditional Tribe of Texas
  • Slots: Yes
  • Table games: No
  • Live poker: Yes
  • Other games: Bingo

The Kickapoo Lucky Eagle Casino Hotel is the only true casino in Texas. It is one of the only places where one can play slot machines or dealer-managed poker in Texas without fear of legal hassles.

Unfortunately, it is also located on the border between the United States and Mexico and is more than two hours from San Antonio, the nearest city of note. Most Texans have not visited this property, many have never heard of it, and those who do know about it typically do so only because it’s a bit of Texas trivia.

  • Address: 540 State Park Road 56, Livingston, Texas
  • Phone: 936-563-2946
  • Tribe: Alabama-Coushatta Tribe of Texas
  • Slots: Yes
  • Table games: No
  • Live poker: No
  • Other games: No

Naskila Gaming is a slots-only casino owned and operated by the Alabama-Coushatta Tribe of Texas. There are roughly 800 machines onsite, all bingo-based devices to allow the casino to retain a Class II designation.

It is located in Livingston, roughly an hour north of Houston. Despite its proximity to Texas’ largest city and a recent court victory clearing the way for it to operate, most Texans don’t head to Naskila in favor of the full-service casinos that are 2 hours to the east in Louisiana.

Responsible gambling in Texas

Unfortunately, there are very few responsible gambling services offered in Texas. The state does not have a centralized self-exclusion program, and the National Council on Problem Gambling does not have a local affiliate in Texas.

However, the University of Texas offers free support at its Austin campus for anyone that has a gambling problem. The university runs a crisis line too (512-471-2255). Meanwhile, Texas Gamblers Anonymous hosts meetings in Austin, Dallas/Fort Worth, Houston, and San Antonio on a weekly basis.

Finally, you can access national services and support, such as the 1-800-GAMBLER helpline. These are some of the best sites to visit:

  • Gamblers Anonymous
  • Gam-Anon
  • GamTalk

Texas Online Casinos FAQ

No, you cannot win real money on social and sweeps sites in Texas. However, you can earn free Sweeps Coins and redeem them for cash prizes. Be aware that you may need to complete a playthrough requirement before you can redeem.

The Texas Lottery Commission would be the most likely candidate to regulate online gambling in the Lone Star State. The commission already oversees charitable bingo and lottery games, so its remit could be expanded to cover online casinos. Alternative options include the Texas Racing Commission or a newly created Texas Casino Commission.

The legal gambling age in Texas is 18. Anyone aged 18 or older can buy lottery tickets, place pari-mutuel wagers, or take part in charitable gaming. Players aged 18 or older can also play games at tribal casinos such as the Kickapoo Lucky Eagle Casino Hotel, although the minimum age goes up to 21 if alcohol is served.

Pari-mutuel wagering is available at horse racing and dog racing tracks in Texas, including Lone Star Park and Sam Houston Race Park. Many tracks maintain simulcast facilities, allowing you to bet on races held across the country, but online racebooks are not permitted in Texas. Charitable gaming is also available, such as charity bingo games.

Yes, you must pay taxes if you earn a profit from your overall gambling activities in a particular year. There is no state income tax in Texas, but you will need to pay federal income tax to the IRS if you end the year in profit. The amount you must pay will depend upon your income bracket.

No, you cannot gamble at online casinos in other states with a VPN. The online casinos have sophisticated measures in place to prevent you from accessing their sites with a VPN, and you can be banned for trying to do so. The best option is to simply play at social and sweepstakes casino sites in Texas.
