The status of legal gambling in New York

Are online casinos legal in New York?

Sen. Addabbo launched a bill seeking to legalize NY online casinos in 2023, but it ultimately proved unsuccessful. However, he was undeterred, and he filed a new online casino bill in January 2024. The bill did not make the state budget, but Sen. Addabbo said it could “materialize at any point.”

In the meantime, players can use social and sweepstakes casinos. They comply with New York sweepstakes law, so you can play games for fun, but you also have the chance to redeem premium coins for cash prizes and gift cards.

The New York online casino bill doesn’t look like it is going to pass, barring Addabbo finding common ground with the New York Hotel and Gaming Trades Council in the coming weeks. However, due to the fact that Senate Bill S8185A is still (technically) active in the New York Senate, let’s discuss what its passage would mean for fans of online casinos in New York.

S8185A allows for the issuance of up to 31 licenses to both existing and new operators in the state. Licensees may only have one skin associated with their license, so 31 is the maximum number of online casinos that could potentially open their virtual doors in New York. Here’s how the license allotment breaks down:

  • 4 licenses reserved for the upstate casinos
  • 3 licenses for the eventual downstate casinos
  • 3 licenses for tribal entities in the state
  • 9 licenses for New York’s video lottery terminal racinos
  • 9 licenses for the online sportsbook operators in New York
  • 3 licenses reserved for minority participants

Existing operators in the state can secure one of these licenses for $2 million. New operators have to pay $10 million. In either case, the license is good for 10 years, and requires licensees to pay 30.5% of revenue as tax to the state.

The final elements of the bill detail some allotments and requirements to help New Yorkers and workers in New York. The language directs no less than $25 million per year to the union (the New York Hotel and Gaming Trades Council) and sets aside an additional $11 million per annum to responsible gambling efforts in the state.

The bill also portends more jobs for New York, as it requires any live dealer options to be managed from locations inside the state itself.

Will New York legalize online casinos in the future?

Possibly. Sen. Joseph Addabbo has introduced SB 8185 in the 2024 session to allow online casinos to proceed in the state. In fact, our legislative experts have placed the likelihood of NY online casino legalization in the current year at 25%.

However, as is the case in many large states, any gambling expansion faces a long, uphill battle because of the many stakeholders in the state. Indeed, Addabbo is already finding resistance with labor unions in the state, who are nervous about iGaming’s effect on land-based casinos and the jobs associated with them.

Lawmakers may also feel less inclined out of a desire to protect the three new land-based casinos in the state. NY online casino proponents may also have to wait for sports betting interests to drop or resolve their disagreements with the state about the high tax rate laid upon the industry.

Is it legal to gamble online in New York?

Although lawmakers have been working to bring online casinos to New York, they remain illegal at this time.

However, various forms of online gambling are legal in New York. Legal online sportsbooks went live in January 2022 after tireless campaigning from a familiar source – State Sen. Addabbo. New York is now the largest sports betting market in North America.

Online racebooks and fantasy sports apps are also legal in the Empire State. However, the state has not yet legalized online casinos and poker rooms.
