Not yet. State Sen. Joseph Addabbo has been the driving force behind NY online casino legalization, but he’s thus far not been able to get a bill over the line. However, every session, Sen. Addabbo continues to put forward legislation and advocate for how igaming would help balance the state’s budget.
As a result, New York makes our list of states to watch for online casino legalization, and we expect it to come sometime soon. However, exactly when it will is hard to say.
In a fairly recent development, sweepstakes casinos are also no longer available in New York.
Senate Bill S5935, also put forward by Addabbo, passed through the NY Legislature and was signed into law by Gov. Hochul in December of 2025. Even before then, all reputable operators had already pulled out of the state after receiving cease-and-desist letters from the State Attorney General.
With real-money casinos not yet legal and sweepstakes casinos banned, New Yorkers don’t have many options when it comes to online casino games. The remaining options are freeplay sites like Hard Rock Social Casino or Baba Wild Slots. There is no prize potential at these sites, just free games.

Legislation to legalize online casinos has been left out of Governor Kathy Hochul’s executive budgets, indicating that the initiative does not currently have executive support. Assemblywoman Carrie Woerner, chair of the Assembly Racing and Wagering Committee, has also voiced doubts about the bill’s chances whenever the subject has come up.
Labor unions, especially those representing casino employees, have also raised concerns about the possible effects of internet gaming on jobs at physical casinos. To counteract possible job losses, the proposed legislation provides $25 million yearly for workforce development and contains provisions for labor peace agreements.
In light of these considerations, considerable obstacles still stand in the way of New York’s continued legislative efforts to legalize online casinos. However, the fact that New York online casinos are discussed during every legislative session still have the Empire State closer to regulation than most others in America. It seems like it’s a matter of when, not if. But that “when” could be later in 2026 or years down the road.
Highly unlikely. The banning bill moved through the state senate with 57-2 support. That’s not the kind of margin that flips easily.
If anything, Sen. Addabbo’s spearheading of the sweeps ban is meant to clear the regulatory path for real-money casinos, like BetMGM and DraftKings.
